WhatsOutsyde

1. Acceptance of terms
By using WhatsOutsyde you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.
2. The service
WhatsOutsyde provides a platform to discover places, events, and experiences in Jamaica and to connect users with local operators. We are a technology platform. We are not the operator of the places or events listed.
3. Accounts
- You must provide accurate information
- You are responsible for keeping your login details secure
- You are responsible for activity under your account
- We may suspend or terminate accounts that breach these terms
4. Bookings and events
WhatsOutsyde is a discovery and introduction platform. A Request to Book is sent to the operator for them to confirm. Instant book confirms immediately when the operator has opted in and you have given a date. In both cases any experience, payment, cancellation, or refund is between you and the operator — we are not a party to it unless we expressly say otherwise.
- We store your request (name, contact, dates, party, notes) so you and the operator can see it in My bookings / Bookings
- Guests without an account must confirm an email with a one-time code before we accept the request. Signed-in users skip that code
- WhatsOutsyde does not take a card for experiences today. Confirmed bookings are pay the operator directly (WhatsApp, cash, or their usual method). Card checkout is not live
- Operators are responsible for listing accuracy, licences, and fulfilling the experience. Prices and availability are set by them
- Event RSVPs and live posts are between you and the host of that event
5. User conduct
You agree not to:
- Misuse the app or attempt to disrupt it
- Post false, misleading, or harmful content
- Harass others or engage in illegal activity
- Attempt to access data or systems you are not authorised to access
6. Listings and operator content
Operators are responsible for their listings, photos, descriptions, prices, and availability. We may remove content that breaches these terms or is harmful.
7. Your content and licence
“User content” means anything you submit — reviews, ratings, photos, listings, event details, comments, or messages. You keep ownership of your user content.
By submitting user content you grant WhatsOutsyde a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce, and distribute that content within the app and in connection with operating and promoting the service. This licence ends when you delete the content or your account, except for copies already shared with others, in backups until they expire, or where we must keep it by law.
You represent and warrant that:
- You own your user content or have all rights needed to submit it
- Your user content does not infringe anyone else’s copyright, trademark, privacy, or other rights
- You will only upload photos you took yourself or otherwise have permission to use — do not upload images copied from Google, social media, or other businesses’ websites
- Your user content is accurate and not misleading, and reviews reflect a genuine, honest experience
Our role. User content reflects the views of the people who post it, not WhatsOutsyde. We are an interactive computer service provider and a hosting platform; we do not create user content and are not responsible for it. We are not obliged to monitor user content, but we may review, refuse, or remove any content at our discretion, including content we believe is unlawful, infringing, deceptive, or harmful.
8. AI features
Some optional features — such as AI trip-planning and the “Ask WhatsOutsyde” concierge — are powered by third-party artificial-intelligence models. When you use them, the text of your request is sent to an AI provider to generate a response.
AI responses are generated automatically and may be inaccurate, incomplete, or out of date. They are for general information and inspiration only and are not professional advice (including legal, medical, financial, or safety advice). Always confirm important details — prices, opening times, safety, and availability — directly with the operator before you rely on them. You are responsible for how you use AI output.
9. Payments
Experience bookings are not charged on WhatsOutsyde. Pay the operator directly. We are not responsible for payment disputes between you and an operator unless we expressly collected that payment.
Host membership (if you buy a plan) is billed by us through Stripe. Additional terms shown at checkout apply. On native iOS, host payments may be gated by the store’s in-app purchase rules. General Consumption Tax (GCT) may apply where Jamaican law requires — amounts are shown at purchase where we know them.
10. Data processing
Where WhatsOutsyde processes personal data on behalf of an operator or business user in connection with bookings, enquiries, or events, the following applies.
Roles. The operator or business is the data controller for personal data they receive about customers (for example booking details). WhatsOutsyde acts as a data processor only to the extent it processes that data on the operator’s behalf to provide the platform.
Purpose. Personal data is processed only to facilitate bookings, enquiries, event registrations, one-time email checks, security, and related platform functionality.
WhatsOutsyde will:
- Process personal data only on documented instructions from the operator (including through use of the platform)
- Apply appropriate technical and organisational security measures
- Ensure that people authorised to process the data are bound by confidentiality
- Help the operator, where reasonably possible, to respond to data subject requests
- Delete or return personal data when the operator’s account is closed, or as otherwise required, subject to legal retention duties
- Not engage sub-processors in a way that breaches applicable data protection law, and remain responsible for their performance
The operator or business will:
- Have a valid legal basis to share customer personal data with WhatsOutsyde
- Meet their own obligations as a data controller under applicable law
- Not use the platform to process personal data in a way that breaches data protection law
International transfers. Where personal data is transferred internationally, appropriate safeguards will be applied as required by applicable law.
11. Intellectual property
The app, design, and related materials are owned by us or our licensors. You may not copy or reuse them without permission.
12. Copyright and DMCA notices
We respect intellectual-property rights and expect our users to do the same. We respond to notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (DMCA) and similar laws, and we terminate the accounts of repeat infringers.
If you believe content in the app infringes your copyright, send a written notice to our Designated Copyright Agent that includes: (1) your physical or electronic signature; (2) identification of the copyrighted work you claim is infringed; (3) identification of the material you claim is infringing and enough detail for us to locate it (for example the listing name and a screenshot or link); (4) your contact details; (5) a statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner’s behalf.

Counter-notice. If your content was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the same agent with the required information under the DMCA. We may restore the content unless the original complainant files a court action.
13. Disclaimers
The app is provided on an “as is” basis. We do not guarantee uninterrupted access or that listings are always accurate or available. We are not responsible for the quality or safety of experiences provided by operators.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect or consequential losses, or for losses arising from interactions between users and operators.
15. Dispute resolution and arbitration
Please read this section carefully — it affects how disputes are resolved and may limit your right to go to court or take part in a class action.
Informal resolution first. If you have a dispute with us, please contact us at jasonhinds1977@gmail.com first and give us 30 days to try to resolve it. Most concerns can be handled this way.
Binding arbitration. If we cannot resolve a dispute informally, you and WhatsOutsyde agree that any dispute arising out of or relating to these Terms or the app will be resolved by final and binding individual arbitration, rather than in court, except as stated below. Arbitration is less formal than a lawsuit and uses a neutral arbitrator instead of a judge or jury.
Class-action waiver. You and WhatsOutsyde agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative action. The arbitrator may not consolidate more than one person’s claims.
Exceptions. Either party may (1) bring an individual claim in a small-claims court that has jurisdiction, and (2) seek injunctive or other equitable relief in court to protect intellectual-property rights or stop unauthorised access to the service.
Opt-out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing jasonhinds1977@gmail.com with your name and a statement that you opt out of arbitration. Opting out does not affect any other part of these Terms.
16. Termination
You may stop using the app at any time. We may suspend or terminate access if you breach these terms or if we need to protect the platform or other users.
17. Changes to the terms
We may update these Terms from time to time. Continued use of the app after changes means you accept the updated terms.
18. Governing law
These Terms are governed by the laws of Jamaica. The courts of Jamaica have jurisdiction, subject to any non-waivable rights you have under the Consumer Protection Act and other applicable Jamaican law. The arbitration and class-action terms in section 15 apply only to the extent they are permitted in your jurisdiction and do not limit those non-waivable consumer rights.
Nothing in these Terms excludes liability or rights that cannot be excluded under Jamaican law.
